Just Swim Membership Terms and Conditions

The following terms and conditions apply to all members and users of the Club and Facilities.

1.     For the avoidance of doubt, reference to “Members” includes Club Members, Hotel guests and day users.

2.     Reference to the “Facilities” includes the Hotel swimming pool and any other Hotel leisure facilities that may be made available from time to time by the Hotel to Members.

3.     Membership to the Club, and use of the Facilities binds Members to the terms herein.

4.     By applying for membership to the Club, a member warrants that they posses the requisite abilities and swimming skills for safe use of the Facilities.

5.     The Club reserves the right to suspend or terminate a membership for any infringement of these rules and terms & conditions.

6.     The Hotel may amend these terms and conditions without notice.

7.     Direct Debit payments will be collected on the 1st of each calendar month, or the nearest business day.

8.     In accordance with BACS Regulations, the Hotel reserves the right to present a request for any uncollected Direct Debit, where returned by the Members bank, without notice, but within one month of the date of the original payment attempt.

9.     Pro-rata payments may be applied to new memberships.

10.   The Club may, at its sole discretion, offer discounts for annual membership payments, and reserves the right to amend or retract these at any time.

11.   The Hotel may, from time to time, offer or amend membership benefits, without notice.

12.   Certain membership benefits may be subject to availability.

13.   Discounted, promotional or concession memberships are excluded from any further discounted offers, whether through the Hotel or a third-party agent.

14.   Upon payment, Members will be issued with a personal identifiable membership card. This card must be presented to gain access to the facilities.

15.   All personal data will be stored in accordance with the Hotels Data Privacy Policy .

16.   Members should notify the Hotel of any amended personal details. Failure to do so may affect membership conditions and benefits.

17.   The membership card remains the property of the Hotel, and must be returned upon termination of membership.

18.   A fee will apply for Replacement cards.

19.   Membership is non-refundable or transferable, and is intended for use by the named Member only.

20.   Termination of membership must be made in writing by the Member, and within 7 working days of the next due direct debit date. Failure to cancel in good time may result in a non-refundable collection of the direct debit.

21.   Access to the Hotel facilities is strictly subject to receipt of payment. Members will have access to the facilities for the duration of their active membership.

22.   Full adult membership applies to any person aged 18 or older.

23.   The Hotel reserves the right, at its sole discretion, to deny membership and/or access to the Hotel facilities.

24.   The Hotel may temporarily amend the terms of use, or suspend or withdraw all or any part of the Facilities as may be required. While every attempt will be made to provide Members with advance notice, the Hotel makes no warranty in this regard.

25.   Use of the facilities is at the members own risk. SBH Cliffden Limited, its employees and affiliates will not be held liable for any personal injury, including illness or death; loss; claim; damages; or other expenses, whether direct or indirect, sustained while using the facilities.

26.   These Terms and Conditions shall be governed by and construed in accordance with the laws of England. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and your use of the site confirms your agreement to this jurisdiction. Any cause of action you may have with respect to your use of this site must be commenced within one (1) year after the claim or cause of action arises.

27.   If any of these Terms of Use is determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms of Use are intended to be effective, then to the extent to which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining Terms of Use shall survive and continue to be binding and enforceable.
